International Criminal Court edges have rejected a prosecution request to keep former Ivory Coast President Laurent Gbagbo in jail while while they appeal his acquittal this week on war crimes charges.

This paves the way for the early release of the man who’s been awaiting trial in the Hague for seven years.

The ICC judges say the prosecution case against former Ivorean President Laurent Gbagbo is exceptionally weak.

It relates to his refusal to accept defeat in 2010 elections.

In the ensuing civil war, more than 3 000 people died and half a million were replaced.

The ICC found earlier this week that the prosecution could not adequately link Gbagbo to the deaths and acquitted him on war crimes charges.

They judges said today they has assurances from Gbagbo that he would return if the prosecution appeal against the acquittal is successful.

Euthenasia activist Sean Davison faces a charge of premediated murder for assisting in the death of a friend left paraplegic after a car accident.

Davison, 57, who was arrested yesterday (Wednesday) has indicated to  the Cape Town court, through his lawyer, that he intends pleading not guilty.

The State did not oppose bail of 1,170 euros for Davison who came to prominence in 2011 after assisting his mother’s death in New Zealand by giving her morphine.

He served a five-month period of house arrest in New Zealand.

Davison, who founded Dignity SA, is charged with the murder of paraplegic Dr Anrich Burger in Sea Point five years ago.

He is due back in court on November 16.

Prosecutor Megan Blow told the court new information had come to light indicating that  Davison has committed other similar offenses of assisted suicides.

Dignity SA co-founder Willem Landman said serious crimes squad detectives had searched Davison house and seized is laptop and mobile phone.

Euthenasia is illegal in South Africa.

Two years ago the state appealed a High Court ruling granting a man the right to a medically assisted death.

The Appeal Court overturned that judgment that could have opened the way to assisted suicides.

Oscar Pistorius is back in Kgosi Mampuru prison in Pretoria to serve out the six year sentence murder imposed on him for murder.

He has to serve half this sentence before being able to apply for parole.

Judge Thokozile Masina, who sentenced him in October 2014 to five years for culpable homicide, found the mitigating evidence outweighed the aggravating factors to be considered in imposing the sentence  for the murder conviction imposed by the Appeal Court last December.

She found Oscar to be a good candidate for rehabilitation.

Masipa says there was no a shred of evidence offered that Oscar has knowingly shot his lover Reeve Steenkamp, so this was not a case of domestic violence or violence against women.

This is, however, the public misperception about the case.

Masina says she has to serve the public interest not address public opinion.

Pistorius’ defence  will not appeal the sentence.

Masipa is waiting in her chamber to see if the prosecution will seek leave to appeal.
